Is It Time to Bring on a Labor Law Posting Compliance Partner?

Labor law posting compliance is complex beyond human capacity. Due to the vast amount of labor laws and accompanying postings, many companies are turning away from in-house labor law compliance programs toward employment law management experts, instead.
Here’s how to know it’s time to outsource your labor law poster needs to a trusted compliance partner:
You have locations in multiple states, counties, and cities.
You may have multiple locations across different states, Canada, or both. Either way, it’s nearly impossible to manage with the constant whirlwind of labor law posting updates at the federal, state, county and city levels of government, AND have time to communicate the changes to each location.
Your company does not have a designated employee who manages labor law compliance.
Employers need at least one full-time employee to track all posting changes, verify with government agencies whether the changes are mandatory, and then coordinate the printing and distribution of the most current versions of labor law posters. This dedicated resource is an actual cost to the company, even if the posters are “free” from government websites.
You have employees with specific posting needs, including remote workers, independent contractors, and Spanish-speakers.
Also, you have employees whose primary language isn’t English, or visually disabled workers who need a reasonable accommodation under the Americans with Disabilities Act. Do you have the resources to accommodate all these different types of employees?
You’ve been hit with litigation for non-compliance.
Each posting you fail to display has its own penalty. For example, failure to post the Family and Medical Leave Act (FMLA) posting has roughly $100 fine. If your company receives a few fines, this may seem manageable. But, imagine if each of your locations was fined. The totals add up, and this doesn’t include the fines you may owe to the employees themselves if faced with litigation. You can view individual posting fines here.
