Posting Activity in 2024
The past year saw significant changes in labor law postings, with 741 updates across federal, state, and local levels. Dana Holle stated that she believes these numbers will continue to grow in 2025. The notable mentions for 2024 are as follows:
- 423 mandatory posting updates introduced, emphasizing the need for businesses to stay compliant.
- Illinois Right to Privacy in the Workplace Posting: Employers using E-Verify must now display this new posting alongside federal Right to Work notices.
- Washington, D.C. Wage Transparency Posting: Employers must create a customized posting that meets compliance requirements.
- San Antonio’s Domestic Violence Posting: Public accommodations such as retail stores and hotels must display notices in restrooms.
Trending Now: Digital & Industry-Specific Postings
- Digital Posting Requirements: Illinois and New York now require employers to provide electronic versions of mandatory labor law posters to employees in addition to displaying physical copies in the workplace. Also, under the Department of Labor’s Field Assistant Bulleting No. 2020-7, under limited circumstances, employers can provide certain federal posters electronically.
- Veterans’ Benefits Postings: More states are introducing notices related to veterans’ employment rights and resources. In the last 2 years, 7 states have released veteran’s benefits and services posting requirements. Michigan is the latest state passing such a requirement effective April 2, 2025 with a posting coming soon.
- Captive Audience Postings: There are 12 states with captive audience laws. 5 of these states have posting requirements. The latest state passing such a law is Illinois with a posting requirement. What has been unusual in connection with these laws is that some states have decided not to create a poster for these requirements. As a result, employers are left to create a compliant poster on their own to display.
- Fair Workweek Postings: Cities like Los Angeles and Berkeley are mandating new scheduling-related postings for retail and fast-food employers. There are eight local jurisdictions that have these laws. The latest jurisdiction to pass this type of law is Los Angeles County which has a posting requirement that is coming soon. We expect to see more of these laws passing in the coming year or so. Once we see Los Angeles and Los Angeles County pass certain laws, we see neighboring counties following their lead and passing similar laws.
Predictions for 2025
There will be updates to federal postings, including revisions to the Know Your Rights: Workplace Discrimination is Illegal posting and the Pay Transparency Nondiscrimination notice as a result of Trump’s executive orders. The EEOC is currently reviewing the Know Your Rights poster but has not issued an updated version yet. The Federal Contractor Pay Transparency posting has been removed from the agency’s website, however there are legal challenges to the executive order removing this requirement and the statutes requiring this posting remain in place. GovDocs is monitoring these changes and will provide updates on these posting requirements.
Looking ahead, we anticipate more states adopting digital posting requirements, following Illinois and New York’s lead. With less oversight at the federal level, states will step in and oversee areas of interest.
We also expect to see an increased focus on pay transparency postings in the coming year.
