As the use of AI and other automated decision-making tools for hiring, performance evaluations, staffing forecasts, etc., become more common in the workplace, expect to see increased regulatory oversight at both the federal and state levels. For instance, the AI-Related Job Impacts Clarity Act was just introduced in the U.S. Senate on Nov. 5, 2025. If passed, it would require covered entities to provide quarterly disclosures and reports on artificial intelligence-related job impacts.
Over the last year, seven jurisdictions adopted new pay transparency legislation requiring employers to provide certain salary ranges, wage scales, and other compensation benefits in job postings. With several pay transparency bills advancing in state legislatures, employers should monitor for newly adopted laws and amendments expanding existing pay transparency requirements.

Now that the federal government reopened and the EEOC reestablished a quorum, expect significant action aimed at revising regulations, implementing guidance, and rescinding pre-Trump Administration rules in line with their Strategic Enforcement Plan (SEP). EEOC priorities under the SEP include pregnancy accommodations, DEI, harassment, disparate impact, religious accommodations, and national origin discrimination.
Paid leave makes the list for the second year in a row, as the U.S. remains the only industrialized country that does not provide paid family medical leave for all workers. While there is low probability for a federal paid family leave plan, employers should continue to keep an eye on local and state paid leave law requirements and changes.

Effective July 20, 2025, Ohio became the first state to allow employers to display labor law posters digitally. Two other states passed similar legislation – New York requires employers to provide electronic versions of mandatory labor law posters on top of physically posting to all employers while Illinois only requires employers to provide digital labor law posters to remote employees. While they may not take Ohio’s path, there is strong potential for states to adopt bills requiring employers to provide digital copies of labor law posters to remote and/or hybrid workers.
