As 2025 unfolded, employers across the United States navigated a rapidly evolving employment law compliance landscape at all levels of government. 1. Trump Administration Rolled Back DEI Initiatives

At the start of 2025, President Trump signed several executive orders rolling back DEI initiatives in federal government. Executive Order 14173, titled “Ending Illegal Discrimination and Restoring Merit-Based Opportunity,” terminated Diversity, Equity, and Inclusion (DEI) programs that aimed to achieve a more inclusive workplace for federal employers, agencies, contractors, and subcontractors.

Executive Order 14173 also revoked a landmark executive order signed by President Johnson in the 1960s that mandated affirmative action programs and non-discrimination obligations for the federal government. President Trump also signed Executive Order 14151 and Executive Order 14168 that substantially affected DEI programs this year.

2. Pay Transparency Laws Surged

2025 was a big year for pay transparency laws in the United States. These laws require employers to disclose salary ranges, pay scales, and/or additional compensation benefits in job postings or upon request. Five states, including Illinois, Minnesota, Massachusetts, New Jersey, and Vermont, as well as two cities in Ohio, Cleveland and Columbus, had pay transparency laws take effect this year. Delaware also passed a new pay transparency law that takes effect in 2027.

A couple of states also passed legislation expanding existing pay transparency requirements. Specifically, Washington enacted SB 5408 allowing employers to correct wage and salary disclosure violations in job postings within five business days to avoid penalties, effective July 27, 2025. California enacted SB 642, which clarifies and expands the definitions of “pay scale,” “wages,” and “wage rates” under its pay transparency law, effective Jan. 1, 2026.

3. Paid Leave Coverage Expanded

The best way to describe paid leave in 2025 in one word is: expansion. Paid leave expanded into several states, including Alaska and Nebraska’s new paid sick leave laws as well as Maine and Delaware’s new paid family medical leave laws where contributions into the respective funds started in 2025. Below highlights several of the paid leave expansions in 2025 in the following states:

Colorado amended its paid family and medical leave insurance program to include an additional 12 weeks of leave to care for a child receiving inpatient care in a neonatal intensive care unit, effective Aug. 6, 2025.

Illinois added paid leave benefits for employees to participate in military funeral honors detail, effective Aug. 1, 2025.
New York expanded its paid sick leave requirements to include an additional 20 hours of paid prenatal leave, effective Jan. 1, 2025.
Washington updated its paid sick leave uses to include school and day care closures for public emergencies, effective Jan. 1, 2025, and qualifying judicial and administrative immigration proceedings, effective July 27, 2025.

4. Veterans’ Benefits Postings Emerged

A significant trend in labor law postings this year was the release of several new state-level veterans’ benefits and services labor law postings. The posters generally include the same information – the Veterans Crisis Line, mental health services, tax benefits, workforce training, driver’s license or plate procurement, legal services, abuse resources, and contact information for local, state, and federal veterans services offices. Five states announced new mandatory veterans’ benefits and services posters in 2025, including Massachusetts, Rhode Island, Michigan, Arkansas, and Pennsylvania.

5. Minimum Wage Rates Increased

While the federal minimum wage has remained stagnant for almost two decades, states and local jurisdictions continue to hike their respective minimum wage rates each year. In 2025, eleven states plus Washington D.C. had state-level minimum wage rates at or above $15. Local jurisdictions in Washington State, including Burien, Tukwila, Renton, Seattle, Everett, and King County, all had over $20 minimum wage rates in 2025, the highest in the nation.
