New Local Minimum Wage in Boulder Colorado

On November 7, 2024, Boulder City Council adopted Ordinance 8664, which created a new minimum wage schedule for employers within the city, which is as follows:

Under the ordinance, an “employee” or “worker” includes any individual working or expecting to work four or more hours in a week within the geographic boundaries of the city. Employers may continue to take a tip credit of no more than $3.02 per hour for food and beverage workers (those that prepare and offer for sale food or beverages to eat). Payroll records must also be retained for at least three years by employers.
Finally, there is a new labor law posting requirement under the ordinance, which requires employers to display a minimum wage poster in English and Spanish in a prominent place at the workplace. If there are remote employees or no ability to display a physical poster in the workplace, employers must provide the information to those employees in paper or electronic form.
The City of Boulder is the newest addition to the recent uptick in local jurisdictions passing new minimum wage ordinances in Colorado. Boulder is now among Denver, Edgewater, and unincorporated Boulder County with minimum wage rates higher than the current state minimum wage of $14.81.
