Highlights:
- The New York Lawful Absence Law went into effect Feb. 23, 2023
- Clarified law to provide that workers can’t be disciplined for lawful absences
- Law was designed to eliminate “no-fault” attendance policies
- However, law does not define legally protected absence
- Employers should interpret the law broadly
- New York has many types of leave laws to employers to monitor
- Employers should review their policies to define lawful absences
- Penalties can be substantial: $10,000 for the first violation and $20,000 for subsequent violations
