  • The New York Lawful Absence Law went into effect Feb. 23, 2023
  • Clarified law to provide that workers can’t be disciplined for lawful absences
  • Law was designed to eliminate “no-fault” attendance policies
  • However, law does not define legally protected absence
  • Employers should interpret the law broadly
  • New York has many types of leave laws to employers to monitor
  • Employers should review their policies to define lawful absences
  • Penalties can be substantial: $10,000 for the first violation and $20,000 for subsequent violations
