Federal Poster Update – August 2016

UPDATED Monday, Aug. 22 – See Customer Impact section for poster shipment timelines.

Due to the Department of Labor’s recent update of two postings – Federal Minimum Wage and Employee Polygraph Protection Act – GovDocs has initiated a Federal Poster Update, which will be sent to all locations starting in August.

This is the second GovDocs Federal Poster Update in the past two months. The first, which focused on the release of the OSHA Injury and Illness Reporting final rule, was fulfilled in July. Click here for reference.

Federal Minimum Wage and Employee Polygraph Protection Act Updates: Background and Details

The Department of Labor (DOL) updated and released two postings Wednesday, July 27 – the Federal Minimum Wage (LFD01) and Employee Polygraph Protection Act (LFD05) – both of which are mandatory for employers to display to employees.

These changes result from an act Congress passed in November 2015 requiring federal agencies to adjust their penalties for inflation, which were to be determined by July 1 and made effective by Aug. 1, 2016. This explains why the DOL released these updates late last week.

As such, the DOL removed the penalty amounts from both postings, in addition to other changes, as follows:

  • Federal Minimum Wage: Removed specific civil monetary penalty amounts in the Enforcement section; added a new section on nursing mothers’ rights to receive reasonable break time to express breast milk; and deleted text from the Child Labor section. Note: The Federal minimum wage rate has not changed.
  • Employee Polygraph Protection Act: Removed the civil penalty limit of $10,000, changed the toll-free phone number and added a TTY phone number.

Posting Effective Dates

The Federal Minimum Wage and Employee Polygraph Protection Act postings are effective Monday, Aug. 1, 2016.

As mentioned above, the Federal Minimum Wage and Employee Polygraph Protection Act postings are effective Monday, Aug. 1, 2016. As a result, the GovDocs Federal Poster Update has a new earliest date for compliance of August 2016. It replaces all previous GovDocs federal posters dated May 2015 or later.

To verify whether your posters are compliant, location managers can scan the QR code with a mobile device.

Production and shipping information is outlined below. In the meantime, your locations can provide proof of compliance by downloading and printing the updated federal postings.

Federal-on-One Customers:

  • Federal-on-One poster shipments will be complete by mid-September.
  • Log into the GovDocs Dashboard to view your locations’ shipment status and tracking details.

State and Federal Combined Poster Customers:

  • State and Federal Combined poster shipments will be complete by mid-September.
  • Log into the GovDocs Dashboard to view your locations’ shipment status and tracking details.

Electronic Customers:

  • Electronic Update: Download the Federal Minimum Wage and Employee Polygraph Protection Act postings.
  • Intranet Poster Program: Federal poster files are available as of Aug. 1.
