Digital Labor Law Posters: 5 Steps to Avoid Noncompliance

Follow these 5 steps to ensure compliance with digital labor law posters as remote work continues to rise across the US.

In 2024, 57% of US employees work remotely in some capacity, meaning many organizations are required to provide digital and physical labor law posters to stay compliant with labor law poster regulations. This trend is not slowing down, and the infamous question remains, “Do remote workers need labor law posters?” The answer is YES, otherwise organizations are not in compliance.

In this article we will touch on 5 steps to avoid noncompliance in the digital era of labor law posters.

1. Have a Plan in Place for Digital Labor Law Posters

As surprising as it may sound with the uptick in remote and hybrid employees, many organizations do not have a formalized digital labor law poster program. This could be due to lack of resources, understanding, or negligence. Regardless, all fully remote and hybrid employees must have access to digital labor law posters for their home location’s jurisdiction to meet department of labor requirements. A plan could include details such as:

  • A team member emailing updated posters
  • A digital space where employees access posters
  • A third-party vendor who manages updates

Putting a program in place is step one for full labor law poster compliance.

2. Know Where Your Employees Live

Labor law posters vary drastically across jurisdictions, meaning employees in different areas need different posters. Make sure you know their exact address – not simply their ZIP code – to determine which posters they need to access. Plus, many remote employees may pick up and move without notifying you.

3. Make Sure They Update in Real Time

There are over 1,800 postings to track annually. Manually updating them via email, potentially delaying delivery or increasing the risk of missing an update puts an organization in noncompliance territory. Update notifications and solutions with real-time accuracy are crucial for effective management of digital labor law posters.

4. Don’t Forget Physical Labor Law Posters

Organizations must still display labor law posters in all physical locations, even when remote employees are covered with digital requirements. If an organization has any physical location, providing a digital poster to employees doesn’t absolve employers of the requirements to display physical locations. Also note that electronic labor law posters should be as easy to access as a traditional poster.

5. Assess Your Future Labor Law Poster Needs

Today, organizations might be set with their digital labor law poster processes knowing that “Yes! Remote workers require labor law posters.” But what about the coming months or years? And what about scaling with organizational growth? If a company is hiring employees who work across the country remotely or within an office, re-evaluating processes, outside partnerships, and roles should happen at least annually, which could spark the need for a stronger and more compliant poster program.
