Labor Law Poster Spotlight California, Connecticut, and Washington

A highlight of several recent labor law poster releases that employers should know about, brought to you by the GovDocs Employment Law and Compliance Team.

California’s Notice to Employees – Injuries Caused by Work Poster

On July 15, 2024, Governor Newsom signed AB-1870, which updated the state’s workers’ compensation and insurance law. Specifically, the legislation added a new requirement that the Notice to Employees – Injuries Caused by Work Poster must include information concerning an injured employee’s ability to consult with an attorney of their rights under California’s workers’ compensation law. These changes went into effect on Jan. 1, 2025.

Accordingly, California released an updated version of the Notice to Employees – Injuries Caused by Work Poster to include the following under the “If You Get Hurt” Section:

“You may consult a licensed attorney to advise you of your rights under workers’ compensation laws. In most instances, attorney’s fees will be paid from your recovery.”

California’s Notice to Employees – Injuries Caused by Work Poster is required to be posted by all employers in a conspicuous location frequented by employees and can be easily read throughout the workday.

The GovDocs Standard Update Program is currently shipping updated California posters to impacted customer locations.

Washington’s Captive Audience Poster

Last year, Washington’s state legislature passed The Employee Free Choice Act (SB 5778), joining the recent captive audience trend that is sweeping across the United States.

Under Washington’s captive audience law, which went into effect June 6, 2024, there is a new labor law posting requirement to display a poster informing employees of their rights under the state’s Employee Free Choice Act. Washington’s Captive Audience poster must be posted by all employers, including the state and its agencies.

Accordingly, GovDocs is shipping new Captive Audience posters out to customer locations in Washington, and the poster will also be included in the GovDocs Intranet Poster Program.

Connecticut’s Paid Sick Leave Poster

Connecticut’s Paid Sick Leave poster went through a major overhaul by its Department of Labor.  This is due to HB 5005, which significantly expanded Connecticut’s paid sick leave requirements.

Effective Jan. 1, 2025, Connecticut’s paid sick leave now applies to 25 or more employees (previously 50 or more employees). The employee count will continue to gradually decrease until Jan. 1, 2027, when the law will cover all employers with 1 or more employees. The law, among other changes, also updated the accrual rate to 1 hour of paid sick leave accrued for every 30 hours worked, the eligible reasons an employee may use paid sick leave, the waiting period for paid sick leave use, and constricting employer requests for documentation. The bill further updated several key definitions, such as who is considered a covered employee and family member.

The above updates are among many of the changes to Connecticut’s Paid Sick Leave poster, which must be posted in a conspicuous place accessible to employees at the workplace in English and Spanish.

Both GovDocs Update Program and Spanish Update Program customers will receive updated posters for their Connecticut locations.

Conclusion

As the new year unfolds, jurisdictions will continue to release new and updated labor law posters across the United States. Employers should consider a proven Labor Law Poster Program to keep locations up to date with the newest labor law posters.
