Illinois Electronic Labor Law Poster Law

Employers with remote and traveling workers in Illinois still have some time to prepare before the state’s electronic labor law poster law goes into effect at the outset of 2024.
Late last month, a new Illinois electronic labor law poster law was passed.
Though not as expansive as the New York State digital labor law postings law, it does require employers to make electronic labor law posters available to certain types of employees.
The governor signed the bill June 30, 2023, and the law goes into effect Jan. 1, 2024.

At a high level, the law will require employers to provide electronic labor law posters to employees who do not regularly report to a physical workplace — remote workers or those who travel for work.
It amends the Illinois:
- Minimum Wage Law
- Equal Pay Act of 2003
- Wage Payment and Collection Act
- Day and Temporary Labor Services Act
According to the changes in the legislation, for the types of employees listed above, employers must:
Provide specified information by email to its employees or conspicuous posting on the employer’s website or intranet site, if such site is regularly used by the employer to communicate work-related information to employees and is able to be regularly accessed by all employees, freely and without interference.
With so many employers continuing to allow employees to work remotely, the law has a major impact on poster compliance for many companies with locations in Illinois.
Again, however, it does differ from the New York State law regarding electronic labor law posters. There, employers are required to provide digital copies of labor law postings to their employees in addition to physically displaying the posters in their workspace. (The digital versions can be provided to employees through the employer’s website or by email. Employers also need to provide notice to their employees that the labor law postings are available electronically.)
