Employers with locations in the Lone Star State should keep an eye out for the Texas workplace violence poster.

The Texas workplace violence poster has garnered some interest from employers of late.

In June 2023, Texas lawmakers passed a bill that requires employers to post notice of certain information regarding reporting instances of workplace violence or suspicious activity.

It goes into effect Sept. 1, 2023, and applies to nearly every employer in Texas.

The law regarding Texas workplace violence and suspicious activity is relatively short. For employers, the gist of the law is:

Each employer shall post a notice to employees of the contact information for reporting instances of workplace violence or suspicious activity to the Department of Public Safety.

This poster must be displayed in a conspicuous place “in sufficient locations to be convenient to all employees and in English and Spanish, as appropriate.”

Meanwhile, officials are to iron out the specifics of the information, but it must contain:

  • Contact information the Texas Department of Public Safety regarding workplace violence or suspicious activity
  • The right for employees to make reports anonymously

However, as of this writing, the Texas workplace violence poster has not been released. Officials from the Texas Workforce Commission are to work with the state public safety department on its contents and will likely release it ahead of the Sept. 1, 2023, effective date. (UPDATE: The poster has yet to be released as of late September 2023.

In 2022, there were 358 mandatory posting updates, a number that has grown steadily since 2016, when there were only 148. Also of note, fines for violations of labor law poster compliance can be steep.

In addition to the fines for noncompliance, a lackluster labor law poster program can indicate to government investigators — who may be examining locations regarding a different issue — that a business isn’t taking compliance seriously.

A strong labor law poster program is the backbone of any organization’s compliance efforts.
